This file explains the changes from TFP version 3-9e to 3-10.

England/Wales Changes
The following changes have been made to all versions of the tenancy agreements to standardise the use of terminology and to ensure continuity throughout the agreements.

Ready to Use Agreements

Four new tenancy agreements have been added:
*	TDS custodial landlord managed
*	TDS custodial agent managed
*	MyDeposits custodial landlord managed
*	MyDeposits agent landlord managed

Contractual Tenancy Agreement
*	4.2.7 Amended to reflect test alarms on a weekly basis and clean quarterly using soft brush
*	4.4.3 Amended to reflect ability of tenant to run certain low risk businesses from home with the prior consent of the landlord i.e. accountancy.  Importantly allowing such a business will not provide the tenant with additional security.
*	4.4.15 Removed reference to smoke alarms

MyDeposits Insured
*	1.8.5 Amended to reflect other agreements by removing the word "tenant" and changed terms and conditions to Insured Scheme Rules.
*	1.8.7 Amended to reflect MyDeposits name and changed terms and conditions to Insured Scheme Rules.
*	4.2.7 Amended to reflect test alarms on a weekly basis and clean quarterly using soft brush
*	4.3.14 Replaced the words "at the end of the tenancy" with "when possession is returned to the Landlord"
*	4.4.3 Amended to reflect ability of tenant to run certain low risk businesses from home with the prior consent of the landlord i.e. accountancy.  Importantly allowing such a business will not provide the tenant with additional security
*	4.4.13 New clause been added placing obligation upon tenant to ensure all adult occupiers have the right to rent during the term.
*	4.4.15 and has had the reference to smoke alarms removed.
*	4.4.16 and has had the first three words removed
*	5.3 Added the following wording to the end of the clause "However, the Landlord is under no obligation to rehouse the Tenant or to pay for any alternative accommodation"
*	6.1 Amended the name of the scheme administrator from "Tenancy deposit solutions" to "Mydeposits is administered by HFIS plc, trading as Hamilton Fraser"

Updated Letters & Sentences

TFP are pleased to announce an update to our Management Forms pack. The update has been prompted by the recent court decision (Bali v. Manaquel) on who can sign prescribed information for deposit compliance and the potential consequences of the upcoming Foxton's case on secret profits. You will find a list of the changes below.

To summarise, the key changes that have been made are as follows:

    Agency Agreement
  • Clause 1.2: Amendment to the deposit compliance clause for let only landlords where the agent has collected the deposit on their behalf and the requirement to provide evidence of compliance before money is released to the landlord.
  • Clause 2.10: Clarification that employees of the agent can sign documentation, prescribed information and relevant notices on behalf of the landlord to remove any ambiguity about such persons having the authorised right to do so. For clarity, where an agent or their employee signs for a landlord, it should always state "employees name as agent for and on behalf of the landlords name"
  • Clause 4.5: Amendment to the clause to cross reference with the "scale of charges" document in the terms of business pack to ensure the landlord is fully aware of the income being received by the agent from tenants and other third parties.
  • Scale of Charges
    •First page: Amendment to include the words inclusive of VAT for all charges/fees where applicable.
    •Second page: Change of the heading from "tenant fees" to "other income" to allow for the expansion of the section on contractors income. If you do not receive income from contractors this section can be deleted.
  • Move Out Checklist
    We have added a document to cover issues which may not be conducted by an outgoing inspection using an inventory clerk i.e. heating timer, electric switched off. This is to provide due diligence evidence in a dispute with a landlord.
